WHAT DOES IT MEAN TO HAVE THE RIGHT TO FUTURE MEDICAL?

You have the right to medical treatment to curer or relive you from the effects of your injury to the body parts set forth in your final settlement document or your Findings and Award if your matter went to trial.

IF I HAVE OTHER MEDICAL INSURANCE THAT IS BETER, FASTER AND EASIER TO USE WHY SHOULD I USE GO THOUGH THE WCAB?

First your private insurance most likely has a provision that say they do not pay for Work Injuries if there is WCAB coverage, and you may find yourself with a bill or Social Security deduction.

Secondly you may want to try to sell your right to future medical treatment to the insurance company for a lump sum payment of your future medical rights. 

HOW DOES USE OR NON-USE OF MY MEDICAL TREATMENT WCAB AFFECT THE VALUATION OF MY CASE?

Insurance companies tend to decide how much they are willing to pay you for your right to future medical treatment based on how much of it you have used in the past year or two AND that cost them money.

Example 1: You have other insurance that is willing to pay for your medical treatment to the part of the body your award is for, the WCAB insurance is happy. It does not cost them anything today, they do not consider it will cost them anything tomorrow. The value of your case is not increased.

Example 2: You legitimately need to go to the doctor, you are pretty sure it will take you an hour to get dressed, an hour to get to the doctor’s office, the doctors will make you wait an hour, were he or she will see you for 5 min and tell you to go home rest and take Tylenol.  You decide it is easier to be in pain today, rest today and tomorrow maybe it will be ok. The WCAB Insurance Company is happy it costs them nothing it does not increase the value of your case.

 Example 3: You go to the doctor every time you legitimately need to. It costs the WCAB Insurance company every time you go, they are SAD. The value of your case may be increased.

WHAT ABOUT MY PRESCRIPTION MEDICATION?

This is the same as going to the doctor. If you use your other insurance or don’t bother getting your medication it does not costs the WCAB Insurance company anything, they are happy, if you get it thought the WCAB system it cost them money, they are SAD. The value of your case may be increased.
